In order to comply with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations, and applicable Guidelines (the “Law”), S.F MBTY, S.A. de C.V., its affiliates and/or subsidiaries, and/or its related parties (“Safe Mobility”), with registered address at Calle Guadalupe Victoria 619, Colonia San Baltazar Campeche, C.P.: 72550, Puebla, Mexico (the “Address”), holder of the rights to the Software called Safe Mobility (the “Software”) for use through the digital platform located at https://www.safemobility.mx/ (the “Platform”) and other present or future digital platforms and web and/or mobile applications owned by it, and with contact email serviceaclientes@safemobility.mx (the “Email”), makes available the following:

PRIVACY NOTICE

To ensure a legitimate, controlled, and informed processing of your personal data, whether currently provided or in the future, and which may be stored in our databases, collected via cookies, or any other web tracking technology, as well as to guarantee your privacy and your right to self-determination by providing us with such data, Safe Mobility is responsible for the use and protection of your personal data, which will be processed based on the principles of legality, consent, information, quality, purpose, loyalty, proportionality, and responsibility as established in the Law.

USE OF INFORMATION

The information you provide us through access, registration, and creation of a User profile on the Platform, or via email, or by filling out forms or surveys—whether in real-time or historically—will be processed and organized to generate data indicators, which Safe Mobility may use to make relevant business decisions. All collected information will be used for statistical purposes, in a generic and non-personalized manner, and will be associated with the growth, maintenance, and management of Safe Mobility, always respecting your privacy. These uses include our internal operations and administration, communication with you, and fulfilling service requests provided by Safe Mobility, as well as to improve, develop, refine, and deliver Safe Mobility’s services through its related parties, affiliates, or authorized providers and/or business partners, establishing appropriate measures to limit the use of the information collected from you solely for legal and authorized purposes in accordance with this Notice, as well as with proper confidentiality and security measures.

“Services” refers to the brokerage services provided by Safe Mobility between business partners and Passengers to organize and plan mobility and/or transportation and/or logistics services through the Platform.

Safe Mobility may also collect your IP address to diagnose server issues or manage the Platform. An IP address is a number assigned to your computer when using the Internet. It is also used to help identify you within a particular session and to gather general demographic information. Safe Mobility may use “push” technology via the app to send notifications with prior user authorization. This communication method has no access to other functions or information on the device used to connect to the Platform. The information may include the URL of origin (whether or not on the Platform), the next URL accessed (whether or not on the Platform), the browser used, pages visited, searches performed, posts, commercial preferences, messages, etc.

USE OF COOKIES

Safe Mobility informs you that, through the use of cookies and similar technologies, it seeks to guarantee the best possible experience on the Platform by providing personalized information, remembering your service and marketing preferences, and helping you obtain the appropriate information. If you require more information about the use of cookies and similar technologies, Safe Mobility provides its Cookie Usage Policy.

USE OF THIRD-PARTY PLATFORMS AS A DATA COLLECTION MEANS

Personal Data may be collected through manual input of requested information on the Platform or through authorization to use data contained in Instagram and Facebook, Inc. platforms, when the User has registered an email account on any of these platforms. Data requests are made via the Platform’s link to the API (Application Programming Interface) integrated into Instagram and Facebook, Inc. platforms.

Similarly, your entry as a user to the Platform’s Services may be subject to initial identity verification through the validity of the provided mobile phone number via SMS (Short Message Service).

1. REQUESTED PERSONAL DATA

Safe Mobility, and/or its controlling companies, subsidiaries, affiliates, related parties (“Related Third Parties”), and/or those third parties that, due to commercial relationships with Safe Mobility, have contracted the use of the Platform’s Services and need to process and/or use your personal data (“Passenger”), and/or due to the nature of their work are business partners providing services via the Platform (“Driver”); and/or due to their work functions need to process and/or use your personal data as providers, service providers, or business partners (“Business Partners”), may request and obtain general personal data, as well as sensitive personal data as defined by law (hereinafter “General Personal Data” and “Sensitive Personal Data”, respectively; jointly referred to as “Personal Data”) of the individuals described below.

Sensitive Personal Data may be requested electronically or physically, understanding that all information provided physically will be considered and treated as if provided and authorized on the Platform, and will be governed by this document.

In all cases, the collection of Personal Data by Safe Mobility is carried out in good faith and for the purposes outlined herein; therefore, it is presumed that the data provided by their owners are truthful and complete, and the responsibility for ensuring their accuracy and completeness lies with the data owner.


Passengers as users of the Platform: The Personal Data collected from Passengers using the Platform is necessary to document the existing or potential commercial relationship and to perform the contracted services. The Personal Data you voluntarily and freely provide, either directly or through your Administrators, includes information that may be included in contracts, letters, forms, lists, databases, or other physical/electronic means, as appropriate, so that Safe Mobility can document the relationship, the usage and selection process of the Platform’s Services, keep proper records of the commercial relationship with your business partners, and ensure full compliance with internal policies, procedures, and other applicable legal obligations.

The Personal Data to be requested includes:

  • General data  

  • Payment data  

  • Trip history

  • Full name

  • Mobile phone number

  • Email address

  • Address

  • Photograph

  • Banking information for billing the Service

  • Credit card number  

  • Bank

  • Origin address and coordinates

  • Destination address and coordinates.

B) Drivers as users of the Platform: The Personal Data collected from Drivers using the Platform to provide Services is necessary to document the relationship with each of them and to perform the contracted services. The Personal Data you voluntarily and freely provide, either directly or through your Administrators, includes information that may be included in contracts, letters, forms, lists, databases, or other physical/electronic means, as appropriate, so that Safe Mobility can document the relationship, the usage and selection process of the Platform’s Services, keep proper records of the commercial relationship with your business partners, and ensure full compliance with internal policies, procedures, and other applicable legal obligations.

The Personal Data to be requested includes:

  • General data  

  • Sensitive data  

  • Vehicle information  

  • Trip history

  • Full name

  • Mobile phone number

  • Email address

  • Proof of address

  • Photograph

  • Birth certificate

  • Gender  

  • Social Security Number 

  • Valid driver’s license

  • Official ID (INE, Passport, Military ID) 

  • Federal Taxpayer Registry

  • Unique Population Registry Code (CURP)

  • Letter of recommendation

  • Educational level

  • Driving history

  • Criminal record

  • Medical conditions

  • Chronic illnesses

  • Medical treatments received and/or ongoing

  • Accidents or surgeries experienced

  • General vehicle information

  • Vehicle registration card

  • Auto insurance

  • Origin location address and coordinates

  • Destination location address and coordinates.

C) BUSINESS PARTNERS OF SAFE MOBILITY, AS USERS OF THE PLATFORM.  

The Personal Data collected from Business Partners through the Platform consists of information that is included or may be included in contracts, letters, forms, lists, databases, or other physical and/or electronic means available within each of the Platform Modules, as applicable, to document the usage and selection process of the Service Modules that make up the Platform; to maintain a proper record of the commercial relationship with Business Partners using the Platform; and to fully comply with internal policies, procedures, and other applicable legal obligations of Safe Mobility.


The Personal Data collected for integration as part of the Platform’s Services for Business Partners includes:

  • Name of the individual or company name;

  • Registered business address;

  • Federal Taxpayer Registry (RFC);

  • Landline and/or mobile phone number;

  • Name and position of the main contact person;

  • Corporate phone number and/or mobile of the main contact;

  • Corporate email of the main contact;

  • Banking details for deposit or electronic transfer of the services provided to the Client;

  • Specific documents required for processing purchase orders or any other documents needed in the modules available on the Platform.


All Personal Data are processed by Safe Mobility and stored in a repository for their treatment and transfer, in order to fulfill the purpose of the Services acquired by the Passenger. AS THE PLATFORM IS A DATA PROCESSING TOOL PROVIDED TO SAFE MOBILITY, WHICH ALLOWS MONITORING AND CENTRALIZATION OF ALL USER INFORMATION, SAFE MOBILITY HAS NO INVOLVEMENT IN THE TRANSFER AND PURPOSE OF USE BY THIRD PARTIES, SO THESE ACTIVITIES ARE GOVERNED BY THE PRIVACY NOTICE THAT EACH THIRD PARTY MAKES AVAILABLE FOR THIS PURPOSE.

2. PURPOSES OF THE DATA PROCESSING

The Personal Data provided to the Service Provider through the Platform will be used as previously described, with the purpose of:


  • Creating and updating User accounts;

  • Verifying User identity;

  • Processing Service requests made through the Platform;

  • Tracking the provided Services and making necessary modifications and improvements;

  • Processing data to create a record of Clients and the Services they use, manage, or oversee via the Platform, as a linking tool with Drivers;

  • Properly operating and delivering the Services purchased by the Passenger;

  • Providing necessary advice and follow-up on contracted Services;

  • Enabling the Passenger and Driver to manage, operate, administer, and monitor the relationship of the Platform’s Services;

  • Activities related to promotion and marketing of new products and/or services offered on the Platform;

  • Developing new products and services for Users;

  • Improving security and protection for both Passenger and Driver;

  • Conducting research, evaluation, development, and improvements to the Platform;

  • Generating statistics to optimize resource use at Safe Mobility;

  • Performing evaluations and ratings of Users to take corrective actions and provide the best service;

  • Processing banking data to carry out payments for Services;

  • Offering and/or facilitating payments for Services;

  • Sharing information with relevant authorities.

Once the purposes of Data processing are fulfilled, and unless there is a legal requirement to the contrary, Safe Mobility may, at its sole discretion and with the data owner’s authorization, use the collected data solely for statistical purposes in a generic and non-personalized manner, associated with the growth, maintenance, and administration of Safe Mobility, always respecting the privacy of the Data owner.

The processing of Personal Data by Safe Mobility, including payment engines set up by Safe Mobility and/or the Client and/or the Driver, will be subject to the terms and conditions of the Privacy Notice of the Business Partners, as contained on the third-party’s website that provides the payment engine services.

3. TRANSFER

TRANSFER OF PERSONAL DATA AND INFORMATION

The Personal Data referred to in this Notice may be transferred to: (i) related third parties and/or business allies, to enhance Safe Mobility’s value proposition and offer additional products and services based on your needs; (ii) judicial authorities, Mexican and foreign, to comply with the Law, legislation, notifications, requests, or judicial orders; (iii) internet service providers that host Safe Mobility’s technological infrastructure; and/or (iv) technical support service providers for the Platform. If any transfer of your Personal Data requires your explicit consent, we will inform you to obtain it.

In all cases, Safe Mobility will communicate this Privacy Notice to these third parties and ensure, through agreements and/or other binding documents, that they maintain the necessary administrative, technical, and physical security measures to safeguard your Personal Data, and that they only use your Data for the purposes for which they were collected. Additionally, both the Passenger and Driver, as responsible for collecting Data and Safe Mobility, which facilitates the collection and processing through the Platform, as well as any other person related to Safe Mobility with access to this information, will be obliged to protect it under the same security and confidentiality standards, and not to disclose or misuse it. Otherwise, they will be liable according to applicable laws.

However, Safe Mobility will not transfer your Personal Data to third parties unrelated to Safe Mobility, except in the cases previously mentioned and as provided by law, without your prior consent.


4. MEANS AND PROCEDURES TO EXERCISE ARCO RIGHTS

As the Data owner, you may request at any time to exercise your rights of access, rectification, cancellation, or opposition (“ARCO Rights”) regarding the treatment of your Data, which consist of: (i) accessing your Personal Data and details of its processing; (ii) rectifying inaccurate or incomplete Data; (iii) canceling Data when you consider they are no longer necessary for the purposes indicated in this Privacy Notice, are being used for unauthorized purposes, or when your contractual or service relationship with Safe Mobility has ended; and (iv) opposing the processing of your Data for specific purposes.

To do so, you must submit your written request to the Service Provider or send it via email, which must contain at least: (a) your full name and address, or another suitable means to communicate the response; (b) documents proving your identity or, if applicable, your legal representative; (c) a clear and precise description of the Personal Data for which you seek to exercise any of the rights; and (d) any other element or information that facilitates the location of the Data or required by current regulations at the time of the request. You may also request additional information about the ARCO rights exercise process via email.

The response to your request will be provided by Safe Mobility within the terms and deadlines established by law. For more information about the status of your request or to clarify doubts regarding the treatment of your Data or the exercise of your ARCO Rights, you can contact the Service Provider or send your request to the email address provided.

5. REVOCATION OF CONSENT; LIMITATION OF USE AND DISCLOSURE OF PERSONAL DATA

You may also revoke, at any time, the consent you have granted to the Service Provider for the processing of your Personal Data, as well as request that the use and disclosure of such data be limited, provided that no legal provision prohibits it. To do so, you must submit your request in writing to the Service Provider, or alternatively, send your request via email, as applicable. This request must meet the same requirements mentioned in Section 4 above.

The response to your request will be communicated to you by Safe Mobility within the terms and deadlines established by law. Nevertheless, you can obtain more information about the status of your request and the response time by contacting the Service Provider or sending your request to the email address, where any clarifications or questions regarding the treatment of your Data and your rights concerning your Personal Data will also be addressed.

If your Personal Data has been previously transferred before the revocation of consent and continues to be processed by Safe Mobility’s data processors, Safe Mobility will inform those processors of the revocation so they can proceed accordingly.

6. CHANGES TO THE PRIVACY NOTICE

Safe Mobility reserves the right to modify and/or update this Privacy Notice, in whole or in part, at its sole discretion. In such cases, it will communicate this here on the Platform itself; and, as applicable to each individual Data owner, through internal channels, or via a notice placed in usual communication channels (physical or electronic) of Safe Mobility and in a visible location at the registered address, or through a written notice sent to your email, as legally required.


7. DIGITAL, ELECTRONIC, OR ONLINE FORM

The Parties agree that the manner to formalize the agreement of their will may be through a Digital, Electronic, or Online format, where it will suffice to manifest their consent via their acceptance, as well as provide personal data on the Safe Mobility Platform, without the need to sign any document.
